Vaping & E-Cigarettes in the Workplace
E-cigarettes are not covered by smoke free legislation ‘Health Act 2006’, as the act of smoking requires a substance to be burnt.
Rules and Policies
Employers can choose whether or not to allow employees to smoke E-cigarettes at work. If you already has policies in place on smoking, drugs and alcohol then a paragraph about E-cigarettes should also be included in your company handbook.
When drafting a Vaping/E-cigarette policy, employers should conduct a risk assessment to assist in deciding what stance to take.
